第1条　目的

本規程は、日本教育学会が刊行する機関誌その他の出版物に掲載される著作物の著作権の取扱い、および研究成果のオープンアクセスに関する基本的事項を定めることにより、著作者の権利を尊重しつつ、学術研究成果の適切な発信、保存、公開および利用を促進することを目的とする。

第2条　対象となる機関誌

本規程において対象とする機関誌は、次の各号に掲げるものとする。
1. 『教育学研究』
2. Educational Studies in Japan

第3条　対象となる著作物

本規程のうち、著作権に関する規定は、本学会が刊行する機関誌その他の出版物に掲載される次の著作物に適用する。

研究論文
研究ノート
書評
研究動向
大会報告
課題研究・シンポジウム記録
巻頭言・編集後記
その他、本学会が掲載するものとして認めた著作物

2　本規程のうち、オープンアクセスに関する規定は、前項のうち、査読つき学術論文である研究論文および研究ノートに適用する。

第4条　著作権の帰属

本学会が刊行する機関誌その他の出版物の編集著作物の著作権は、本学会に帰属する。

2　本学会の機関誌その他の出版物を構成する個々の著作物の著作権は、当該著作物の著作者が保持する。

3　編集著作物に関する使用料は、本学会の収入とする。

第5条　本学会への利用許諾

著作者は、本学会に対し、当該著作物を機関誌その他の出版物に掲載し、刊行し、電子化し、保存し、J-STAGEその他本学会が認める電子的媒体またはデータベースに登載し、公衆送信し、閲覧およびダウンロードに供するために必要な範囲で、著作物を利用することを非独占的に許諾する

2　前項の利用許諾は、本学会による機関誌の刊行、電子版の作成、J-STAGEへの登載、一般公開、アーカイブ保存、メタデータ作成、DOI付与、検索サービスへの提供、およびこれらに付随する形式変換その他の技術的処理を含むものとする。

3　本学会は、前二項に定める利用のために必要な範囲で、JST（科学技術振興機構）その他の機関または事業者に業務を委託し、または必要な利用を許諾することができる。

第6条　著作者人格権への配慮

本学会は、著作物の利用にあたり、著作者人格権を尊重する。

2　本学会は、機関誌の編集、校正、組版、電子化、形式変換、メタデータ作成その他刊行および公開に必要な範囲で、著作物に形式上または技術上必要な修正を行うことができる。ただし、著作物の内容を実質的に変更する場合には、著作者の確認を得るものとする。

第7条　J-STAGEにおける公開

本学会は、機関誌に掲載された著作物を、刊行後、J-STAGEに登載する。

2　『教育学研究』に掲載された著作物については、刊行後6か月を経過した後、J-STAGE上で公開する。

3　Educational Studies in Japanに掲載された著作物については、クリエイティブ・コモンズ・ライセンスを付与し、刊行後すみやかに、J-STAGE上で公開する。

4　その他の出版物についての公開の対象、期間その他必要な事項は、理事会または編集委員会が別に定める。

第8条　機関リポジトリ等における著作者による公開

『教育学研究』の研究論文および研究ノートの著作者は、第7条第2項の定めにかかわわらず、当該著作物について、掲載版PDFを、所属機関の機関リポジトリその他非営利の学術情報基盤において公開することができる。

2　著作者が第1項に基づき著作物を公開する場合には、次の書誌情報を明記することが望ましい。

第9条　『教育学研究』における利用条件

『教育学研究』に掲載された著作物については、原則としてクリエイティブ・コモンズ・ライセンスを付与しない。

2　J-STAGEにおいて一般公開された『教育学研究』掲載著作物については、閲覧およびダウンロードを認める。

3　前項の定めは、著作権法上認められる私的使用、引用、教育利用その他の利用を妨げるものではない。

4　転載、翻訳、改変、再配布、商用利用その他前二項の範囲を超える利用については、著作権法上認められる場合を除き、著作者または本学会の許諾を得なければならない。ただし、本学会が許諾を行うことができる範囲は、著作者から本学会に許諾または委任された範囲に限る。

第10条　Educational Studies in Japan における利用条件

Educational Studies in Japan に掲載された研究論文および研究ノートについては、クリエイティブ・コモンズ・ライセンスを付与することを原則とする。

2　前項のライセンスの種類は、編集委員会の内規に定める。

3　クリエイティブ・コモンズ・ライセンスが付与された著作物の利用条件は、当該ライセンスの定めるところによる。

4　著作者は、採択時に、当該著作物にクリエイティブ・コモンズ・ライセンスが付与されることに同意するものとする。

第11条　第三者著作物の利用

著作者は、著作物中に第三者の著作物を利用する場合、著作権法上許容される場合を除き、必要な許諾を得る責任を負う。

2　前項の第三者著作物には、図表、写真、教材、調査票、翻訳資料、ウェブサイト上の資料、映像、音声、その他第三者が権利を有する著作物を含む。

3　著作者は、第三者著作物の利用にあたり、出典表示その他必要な表示を適切に行わなければならない。

4　第三者著作物の利用に関して紛争が生じた場合、著作者は、本学会に故意または重大な過失がある場合を除き、自己の責任においてこれに対応するものとする。

第12条　研究データ等の取扱い

研究論文および研究ノートに関係する研究データ、調査資料、授業記録、インタビュー記録その他の根拠資料の公開については、当該研究論文および研究ノートの著作者が、研究倫理、個人情報保護、研究参加者の同意、所属機関の規程、研究助成機関の方針等を踏まえて適切に判断するものとする。

2　本学会は、前項の資料について、一律の公開を義務づけない。ただし、研究助成機関その他の方針により公開が求められる場合には、著作者は、個人情報および研究倫理上の配慮を行ったうえで、適切な方法により対応するものとする。

第13条　二次利用の申請

本学会の機関誌に掲載された著作物について、第三者から転載、翻訳、改変、再配布、商用利用その他の二次利用の申請があった場合、本学会は、必要に応じて著作者に確認する。

2　著作権が著作者に帰属する著作物について、本学会が著作者から許諾または委任を受けていない利用を第三者に許諾することはできない。

3　Educational Studies in Japan に掲載された著作物で、クリエイティブ・コモンズ・ライセンスが付与されているものについては、当該ライセンスの範囲内で第三者が利用することができる。

第14条　著作者による再利用

著作者は、自らの著作物を、著書、論文集、授業資料、講演資料、研究報告書その他の自己の教育研究活動において再利用することができる。

2　前項の再利用にあたっては、著作者は、当該著作物が本学会の機関誌に掲載されたものであることを明記し、書誌情報を表示するものとする。

3　著作者が掲載版PDFを再利用する場合の取扱いは、本規程第8条第2項に定めるところに従う。

第15条　規程の変更

本規程の変更は、理事会の議を経て行う。

2　本規程の運用に必要な細目は、理事会または編集委員会が別に定めることができる。

第16条　適用

本規程は、施行日以後に掲載される著作物に適用する。

2　施行日前に掲載された著作物については、従前の規程または本学会の判断による。

附則

1　本規程は、2027年3月1日から施行する。

2　本規程は、本学会の投稿要領その他関連規程と整合的に運用する。

3　本規程に定めのない事項については、著作権法その他関係法令、研究倫理上の原則、および本学会の関連規程に従う。

Japanese Educational Research Association Regulations on Copyright and Open Access

Article 1　Purpose

The purpose of these Regulations is to promote the appropriate dissemination, preservation, release, and use of the outcomes of academic research, with respect for the rights of authors, through stipulating basic items on the handling of the copyright of works published in the journals and other publications of the Japanese Educational Research Association (below, “the Association”) and on the open access of research results.

Article 2　 Applicable Journals

The journals to which these Regulations are applicable include the following items.

Kyoikugaku Kenkyu [The Japanese Journal of Educational Research]
Educational Studies in Japan: International Yearbook

Article 3　Applicable Works

The regulations within these Regulations on works apply to the following works published in the journals and other publications of the Association.

Research papers
Research notes
Book reviews
Research trends
Conference reports
Thematic research/symposium records
Editorial notes
Other works recognized by the Association for publication

2　The regulations on open access herein apply, within the items in the previous paragraph, to peer-reviewed research papers and to research notes.

Article 4　Ownership of Works

2　Copyright for the individual works constituting the journals and other publications of the Association is held by the author of each work.

3　Usage fees for editorial works shall accrue to the Association.

Article 5　Permission for Use by the Association

Authors grant non-exclusive permission to the Association for the use of their works, within the scope required for publishing the work in the Association’s journals or other publications, digitizing it, preserving it, listing it in electronic media or databases recognized by the Association such as J-STAGE, transmitting it to the public, and enabling its viewing and downloading.

2　The permission for use indicated in the previous paragraph includes publication in the Association’s journals, creation of an electronic version, listing on J-STAGE, open access, archival preservation, metadata creation, DOI appending, provision to search services, and the format conversion and other technical processing required therefor.

3　Within the scope required for the uses indicated in the previous two paragraphs, the Association contracts and/or permits the required use to JST (Japan Science and Technology Agency) or other organizations or businesses.

Article 6　Consideration for Authors’ Moral Rights

The Association respects the moral rights of authors with regard to the use of their works.

2　The Association may make formatting or technical corrections as needed to works, within the scope required for journal publication and release, including editing, correction, layout, digitization, format conversion, creation of metadata, et cetera. However, effective changes to the content of works shall require confirmation from the author.

Article 7　Access on J-STAGE

The Association lists works published in its journals on J-STAGE after publication.

2　Works published in Kyoikugaku Kenkyu are made accessible on J-STAGE six months after publication.

3　Works published in Educational Studies in Japan are made accessible on J-STAGE immediately after publication, with a Creative Commons license appended.

4　Applicability and timing for access to other publications shall be separately decided by the Board of Trustees or the Editorial Board.

Article 8　Release by Authors to Organizational Repositories, etc.

Authors of academic papers and research notes in Kyoikugaku Kenkyu may, regardless of the provisions of Article 7, Paragraph 2, release a PDF of the work in question as published to the repository of the organization with which they are affiliated or to other non-profit academic information platforms.

2　When releasing works as stated in Paragraph 1, authors are recommended to include the following bibliographic information.

Article 9　Conditions of Use for Kyoikugaku Kenkyu

As a rule, Creative Commons licenses are not appended to works published in Kyoikugaku Kenkyu.

2　Viewing and downloading of works published in Kyoikugaku Kenkyu and made accessible on J-STAGE is permitted.

3　The provisions of the previous paragraph do not prevent personal use, citation, or educational use as permitted by the Copyright Act.

4　With regard to uses beyond the scope of the previous two paragraphs, such as reproduction, translation, modification, reissuance, commercial use, et cetera, excluding situations provided for by the Copyright Act, the permission of the author or the Association is required. However, the scope for which the Association may give permission is limited to permission or authorization given by the author to the Association.

Article 10　Conditions of Use for Educational Studies in Japan

As a rule, Creative Commons licenses are appended to research papers and research notes published in Educational Studies in Japan.

2　The Internal Regulations of the Editorial Board shall determine the types of the licenses referred to in the previous paragraph.

3　The conditions of use for works with a Creative Commons license are provided for by the license in question.

4　Authors are considered to have consented upon acceptance of their works for publication to the appending of a Creative Commons license to the work.

Article 11　Use of Third-Party Works

When using the works of a third party in their own works, except for situations allowed by the Copyright Act, authors shall be responsible for acquiring the required permissions.

2　The works of a third party, as stated in the previous paragraph, include diagrams and drawings, photographs, teaching materials, survey responses, translated materials, online materials, video, audio, and other works of which the rights are held by a third party.

3　When using third-party works, the author must appropriately indicate the source and other information as required.

4　Should a conflict arise with regard to the use of third-party works, the author shall be responsible for its resolution, except for situations involving deliberate action or grave error on the part of the Association.

Article 12　Handling of Research Data, etc.

With regard to the accessibility of research data, research materials, lesson records, interview records, and other supporting material related to research papers and research notes, the author of the relevant research paper or research note shall make appropriate judgments based on research ethics, protection of personal information, consent of research participants, regulations of the affiliated institution(s), policy of the research funding institution(s), et cetera.

2　With regard to the materials in the previous paragraph, the Association does not consider general open access compulsory. However, when access is called for by the policy of the research funding institution(s), et cetera, the author shall take appropriate action with consideration for personal information and research ethics.

Article 13　Applications for Secondary Use

When the Association receives a third-party application for reprinting, translation, modification, reissuance, commercial or other secondary use of works published in its journals, it shall consult with the author as needed.

2　For works where the copyright belongs to the author, the Association may not grant permission for use to a third party without the permission or authorization of the author.

3　Third parties may use works published in Educational Studies in Japan to which a Creative Commons license has been appended within the scope of the license.

Article 14　Reuse by Authors

Authors may reuse their own works for individual or shared publication, lesson materials, lecture materials, research reports, or other uses for their own educational and research activities.

2　With regard to the reuse in the previous paragraph, authors shall clearly indicate the publication of the work in the Association’s journal and display bibliographic information.

3　Article 8, Paragraph 2 of these Regulations provides for the process to be followed when authors reuse PDFs of their works.

Article 15　Changes to the Regulations

Changes to these Regulations shall take place through discussion at the Board of Trustees.

2　Details required for the implementation of these Regulations may be separately stipulated by the Board of Trustees or the Editorial Board.

Article 16　Application

These Regulations apply to works published on or after the date of enaction.

2　Works published before the date of enaction shall be handled in accordance with the previous Regulations or the Association’s judgment.

Appendix

1　These Regulations shall be enacted as of March 1, 2027.

2　These Regulations shall be implemented complementarily with the Application Guidelines and other related regulations of the Association.

3　Items not stipulated in these Regulations shall be handled in accordance with the Copyright Act and other relevant laws and regulations, the principles of research ethics, and the relevant regulations of this Association.
